الملخص
تهدف الدراسة إلى بيان مدى مواكبة القضاء الإداري الأردني للاتجاهات الحديثة في الرقابة على السلطة التقديرية للإدارة، تتمثل مشكلة الدراسة في أن القضاء الإداري الأردني لم يجار القضاء الإداري المقارن في توجهاته الحديثة في الرقابة على سلطة الإدارة في التقدير، مما يُضعف قدرته على تشكيل ضمانة حقيقية لحقوق وحريات الأفراد في مواجهة الإدارة. واتبعت الدراسة المنهج الوصفي والتحليلي والمقارن، وتوصلت الدراسة إلى أن القضاء الإداري الأردني لم يأخذ بهذه الاتجاهات الحديثة بشكل كلي وإنما اكتفى بجزء منها، وتوصي الدراسة بضرورة مواكبة القضاء الإداري الأردني للاتجاهات الحديثة في الرقابة على السلطة التقديرية للإدارة. The study aims to show the extent to which the Jordanian administrative judiciary keeps pace with modern trends in monitoring the discretionary authority of the administration. The problem of the study is that the Jordanian administrative judiciary has not kept pace with the comparative administrative judiciary in its modern trends in monitoring the discretionary authority of the administration, which weakens its ability to form a real guarantee of rights and freedoms. Individuals versus management. The study followed the descriptive, analytical and comparative approach, and the study concluded that the Jordanian administrative judiciary did not fully embrace these modern trends, but only part of them. The study recommends the need for the Jordanian administrative judiciary to keep pace with modern trends in monitoring the discretionary authority of the administration
