العِلَّةُ بَيْـنَ التَّخْصِيصِ والنَّقْضِ عِنْدَ الأُصُولِيِّـين The Problem Between Allocation And Negation For Fundamentalists

الملخص
الهدف من هذا البحث تحريرُ مسألة أصوليّة ذات أهمّية بالغة في باب القياس؛ وهي" تَرَدُّدُ العِلَّةِ بَيْـنَ التّخْصِيصِ والنَّقْض"؛ بالوُقوف على مذاهب الأصوليّين المختلِفين فيها، وعرض أدلّتهم، ومناقشتها، واختيار الرّاجح منها، وبيان أسباب الخلاف، وأهمّ ثماره الأصولية؛ إذ إنّ هذه المسألة تعتبر من أدقّ مسائل الأصول وأكثرها تشعّبًا؛ لكثرة مُتَعَلَّقاتِها؛ فهي - من جهة - ترتبط بالقياس الأصوليّ بمعناه الخاصّ والمعروفة أركانُه، ومن جهة أخرى لها تعلُّقٌ بالقياس العامّ المتمثّل في القواعد العامّة للشّريعة، وما خرج عنه من الفروع، كما تبرز أهميّتها كذلك في ما تَفَرَّعَ عن الخلاف فيها من مسائل أصولية، وما ترتّب عليه من ثمار فقهية. وقد تمّ اختيار مذهب القائلين بجواز تخصيص العلّة مطلقا، وأنّ ذلك لا يُعَدُّ نَقْضًا لها، ولا قادِحًا في عِلِّيَّــتِها ابتداءً، ولا مُبْطِلاً للوُثُوق بها؛ بل هو من قبيل تخصيص العامّ مع بقائه حُجَّةً في غير موضع التّخصيص؛ بناءً على أنّ العموم من عَوارض المعاني كما هو من عوارض الألفاظ، ونحو ذلك من الـمُرجِّحات التي أتى عليها البحث بالبيان والتفصيل، والتعليل والتمثيل. The aim of this research is to free up a fundamentalist issue of great importance in the measurement section; namely," the frequency of the reason between allocation and Cassation"; by standing on the doctrines of the different fundamentalists in them, presenting their pieces of evidence, discussing them, choosing the most correct ones, and indicating the reasons for the dispute, and the most important of its fundamentalist fruits; as this issue is considered one of the most accurate and its importance is also highlighted in the fundamental issues that have arisen out of the dispute، And the resulting fruits of jurisprudence. The doctrine of those who say that it is permissible to allocate the cause at all has been chosen, and that this is not considered to be a negation of it, nor leading in the beginning, nor invalidating its reliability, but rather it is a kind of allocation of the general, while remaining an argument in a non-allocation position; based on the fact that the general is one of the symptoms of meanings as it is from the symptoms of words, and so on from the probabilities on which the research came by statement, detail, explanation and representation.
