بطلان التبليغ الرسمي في ظل القانون الجزائري

الملخص
جاء القانون بمجموعة من المبادئ والقواعد الّتي تنظّم الكيفيّة الصّحيحة لطرح النّزاع أمام القضاء، من أجل الفصل فيه بين الأطراف المتخاصمة، إحقاقا للمبدأ المكفول بالمادة 37 من الدّستور الجزائريّ. تقوم الخصومة القضائيّة على مجموعة من القواعد القانونيّة؛ منها الموضوعيّة المرتبطة بالحقّ المطالب به أمام القضاء من حيث الإثبات والاحتجاج، وأخرى إجرائيّة تنظّم الطّريقة الصّحيحة في المطالبة بالحقّ الموضوعيّ. والقواعد الإجرائيّة على اختلاف صورها هي قواعد قانونيّة ملزمة، يرتّب القانون على مخالفتها جزاء البطلان متى تم التمسّك به أمام القضاء. ويعد التّبليغ الرّسميّ الموكل القيام به من طرف المحضر القضائيّ من أهمّ الإجراءات القانونيّة الشّكليّة الّتي تعرفها الخصومة القضائيّة، والّتي طلب فيها القانون الجزائريّ ضرورة توفّره على شكليّات معيّنة وجب احترامها حتى يؤدّى الأثر القانونيّ المطلوب منه، وأنّ مخالفة التّبليغ الرّسميّ للإجراءات الشّكليّة الواجبة يترتّب عنه جزاء البطلان. The law came with a set of principles and rules that regulate the correct way to bring a dispute before the judiciary in order to decide it between the disputing parties in accordance with the principle guaranteed by Article 37 of the Algerian Constitution. Judicial litigation is based on a set of legal rules. Among them are the objective ones related to the right claimed before the judiciary in terms of proof and protest, and others are procedural that regulate the correct way to claim the substantive right. The procedural rules in their various forms are binding legal rules, and the law imposes a penalty of invalidity if they are adhered to before the judiciary. The official notification entrusted to be carried out by the judicial record is considered one of the most important formal legal procedures known to the judicial dispute, in which Algerian law requires that it must have certain formalities that must be respected in order to produce the legal effect required of it.Violation of the official notification of the due formal procedures results in a penalty, which is invalidation.
