الملخص

ملخص: تهدف جميع المؤسسات إلى تحقيق وضعية احتكار على السوق والحفاظ عليها لفترة طويلة من الزمن، وهذا يعتبر أمرًا مشروعًا ومميزًا بالنسبة لها، إلا أن هذا الوضع يتغير ويصبح غير مرغوب فيه عندما يتم استغلاله بشكل تعسفي. فحماية المنافسة تعد من الالتزامات الأساسية التي جاء بها القانون الدولي والمقارن في مجال حماية التجارة والاستثمارات الأجنبية والداخلية ، فأصبح مهم وضروري للدولة على المستوى المحلي لتعمل جاهدة على ضبطها والتحكم فيها بوضع قيود تحظر أي ممارسات من شأنها أن تقيد أو تمنع المنافسة داخل السوق. وعليه فالمشرع الجزائري استجاب لهذه المسألة فوضع قواعد قانونية في مجال المنافسة تعمل على ضبط السوق وحمايته من مثل هاته الممارسات ، مما يثور التساؤل حول مدى استغلال المؤسسة للوضع المهيمن في منظور قانون المنافسة الجزائري 03-03 المعدل والمتمم. Abstract: All organizations aim to achieve a dominant market position and sustain it for a long period of time, which is considered a feasible and distinctive goal for them. However, this position becomes undesirable when it is exploited arbitrarily, leading to a change in the dynamics of the market. Competition protection is one of the fundamental obligations established by international and comparative law in the field of trade protection and foreign and domestic investments. It has become important and necessary for the state at the local level to work diligently to regulate and control it by imposing restrictions that prohibit any practices that may restrict or prevent competition within the market. The Algerian legislator responded to this issue by establishing legal rules in the field of competition that work to regulate and protect the market from such practices. This raises questions about the extent to which the institution exploits the dominant position from the perspective of the Algerian Competition Law 03-03, as amended and supplemented.
