الملخص
ملخص: إن عقود تفويض المرفق العام على اختلاف أشكالها, لها مدة محددة لسريانها والتي تنتهي بانتهاء هذه الأخيرة , مما يجعل العقد يزول بشكل طبيعي, غير أن الأمر لا يكون هكذا في كل الحالات فقد تعتريه ظروف تؤثر على مساره العادي وتجعله عرضة للإنهاء بطريقة غير طبيعية ,سواء بسبب اخلال أحد الأطراف بالتزاماته أو لأسباب فرضتها المصلحة العامة .مما جعل هذه الدراسة ترتكز على معرفة حالات انهاء عقد تفويض المرفق العام و ما تخضع له من شروط .مع بيان الأحكام التي تخضع لها عملية تحويل المرفق العام إلى السلطة المفوضة بعد انهاء عقد التفويض , وما يؤول إليها من أملاك وما يبقى في حوزة المفوض له . هذا التحويل الذي يفرض ضمان سلامة وشفافية عملية تسليم الأموال والمرفق العام درئا لأي نزاع قد ينشأ عن عدم التقيد بإجراءات انهاء عقد التفويض بالشكل الصحيح. مما يفرض التخطيط والاعداد المسبق لعملية انهاء عقد التفويض بموجب نصوص تعاقدية أو تنظيمية . Abstract: Delegation contracts for public facilities ,in all their various froms , have a specified duration that naturally expireswith its termination n however this is not always the case as circumstances may affect its regular cours and make it susceptible to an unusual termination , whether due to a breach of obligation by one of the parties or for reasons driven by the public interest ,this study is basedon understanding the cases of terminating a public facility delegation contrat and the condition it is subject to, along with specifying the provisions governing the process of transferring the public facility to the delegated autority after the delegation contract termination ,it also outlines the assets and what remains in the possession of the delegated , this transformation with mandates the safety and transparency of the public facility ‘s money transfer process guards against any Disputes that may arise from non-compliance with the correct termination procedures, thus preplanning and preparation for the delegation contrat termination process are crucial through The establishment of precise contractual or regulatory texts
