الملخص

أدى ظهور التجارة الإلكترونية التي تتميز بسمات مختلفة، الى المساهمة في إعمال وظهور منهج القواعد المادية للتجارة الالكترونية، هذا الأخير الذي تتميز قواعده بأنها تعطي حلا مباشرا للنزاع، ويستمد أساسه من العادات والأعراف التجارية. وقد تعددت مصادره بين دولية، ووطنية سعت بدورها الى خلق قواعد مادية في طيات قوانينها. إن منهج القواعد المادية لا يشكل نظاما قانونيا مكتمل الأركان، فهو لا يزال في طور البناء، ويحتاج الى جهود أكثر في سبيل تطويره، إلا أن تنظيم قواعده سيشكل قانونا مستقلا ينظم معاملات التجارة الالكترونية، وقادرا على معالجة منازعات البيئة الرقمية. ABSTRACT : The Electronic commerce that has features different , contributed to the realization and emergence of the curriculum of material rules, the latter, whose rules are characterized by providing a direct solution to the conflict , derive its basis from commercial customs and norms. And its sources have varied between international and national sought in turn to create material rules within their national laws. The material rules curriculum doesn’t constitute full legal system, it’s still in the process of being built, and it needs more efforts to develop it, but the regulation of its rules will constitute a separate law governing electronic commerce transactions and able to handle disputes in a digital environment
