شرعية الجزاء الجنائي الدولي قبل و بعد صدور ميثاق روما

الملخص
لقد مر الجزاء الجنائي الدولي بمراحل مختلفة تميزت كل منها بظروف معينة جعلت من اتجاه القضاء الدولي الجنائي يتفاعل معها و مع الظروف السياسية التي عاصرت قيام المحاكم الدولية الجنائية و قيل فيها الكثير عن شرعية الجزاءات التي نطقت بها و حاجتها الملحة لتأكيد شرعيتها. إلى أن تمكن العالم من وضع جهاز قضائي دولي جنائي أنيط به مهمة متابعة و محاكمة المتهمين بارتكاب جرائم ترقى لتكون جرائم دولية، يكون مستقلا و بعيدا عن كل الميول السياسية الدولية. و بذلك تحقق للعالم وضع آلية قانونية من شأنها رفع كل الشبهات التي علقت و عابت الجزاءات الجنائية الدولية التي أصدرتها الكثير من المحاكم الجنائية الدولية المختلفة عبر فترات تاريخية متلاحقة و ظروف سياسية متميزة كل واحدة عن الأخرىن بحسب الغرض الذي أنشأت من أجله المحكمة و الغاية التي سن من أجلها الجزاء. لتكون المحكمة الجنائية الدولية بنظامها الفيصل الراهن لسن جزاءات جنائية دولية شرعية نالت موافقة كل الدول التي صادقت على هذا الميثاق. Abstract: International criminal punishment has gone through different stages, each characterized by certain circumstances that made the evolution of international criminal justice interact with it and with the political conditions that saw the creation of international criminal tribunals. Until the world can establish an international criminal judicial body responsible for monitoring and judging those accused of having committed crimes constituting international crimes, independent and away from all international political tendencies. Thus, the world succeeded in developing a legal mechanism that would raise all suspicions that would suspend and violate the international criminal sanctions issued by many different international criminal tribunals through successive historical periods and political circumstances distinct from each other according to the purpose. for which the tribunal was established and the purpose for which it was enacted To be punished. To be the International Criminal Court, with its current system, the final decision to enact international criminal sanctions, it has obtained the approval of all the countries that have ratified this charter.
