الملخص
ملخص: يهدف هذا المقال الى تسليط الضوء على شروط الترشح لشغل منصب رئيس الجمهورية وفقا للقواعد الدستورية ضمن مجمل الدساتير الجزائرية,من خلال دراسة وتحليل القواعد الدستورية المنظمة لشروط الترشح لمنصب رئيس الجمهورية وإبراز اثر التغيير الذي طال النظام السياسي في الجزائر على هذه الشروط,وإظهار مدى ارتباطها بمركز رئيس الجمهورية,سواء من حيث وجوب توفرها في شخص المترشح لتقلد المنصب,أو من حيث دعمها لمركز رئيس الجمهورية داخل السلطة التنفيذية,حيث توصلت الدراسة الى تصنيف شروط الترشح لمنصب رئيس الجمهورية الى فئتين صنفت الاولى منها بذات الاهمية و الفعالية المؤثرة في شخص المترشح ومنصب الرئاسة وأخرى فقدت جدواها وأهميتها مع مرور الزمن,كما اكدت الارتباط الوثيق بين وجودها ومركز رئيس الجمهورية داخل السلطة التنفيذية,بحيث تقاسمت معه المهام فمن جهة تقدم هذه الشروط دعما لمركز رئيس الجمهورية داخل السلطة التنفيذية ومن جهة اخرى يعطيها رئيس الجمهورية ايضا اهتماما خاصا يدعم مركزه ايضا ويبقي وجوده فترة اطول على هرم السلطة. Abstract: This article aims to shed light on the conditions for running for the Presidential position of the Republic according to the constitutional rules within the Algerian successive constitutions. It does so by studying and analysing the constitutional rules regulating the conditions for presidential candidacy and highlighting the impact of the changes that have affected the political system in Algeria on these conditions. The study also illustrates the extent of their connection to the position of the President of the Republic, both in terms of their necessity in the candidate's persona and their support for the President's position within the executive authority. The study categorizes the conditions for presidential candidacy into two groups: one deemed of significant importance and effectiveness in the candidate's persona and the presidential position, and the other group that has lost its relevance and significance over time. The research confirms the close connection between these conditions and the position of the President of the Republic within the executive authority. These conditions, on one hand, provide support for the President's position within the executive authority, and on the other hand, the President himself gives them special attention to bolster his position and maintain his presence atop the power hierarchy for a longer period.
