Towards A Law For The Constitutional Court; Balancing Procedaral Necessity And Substantive Necessity

Abstract
The constitutional transition from the contitutionel Concil body The constitutional court system, according to the recent constitutional amendment of 2020, alings with the current contitutionel developments in the field of constitutional oversight and normativity of constitutional principles. This transition entails a shift from political supervision to judicial oversight, aiming for constitutional justice moreover, while some consider the establishment of the constittutionel court as advantageous, as it shifts from an elitist official judiciary to a (peoples judiciary), it necessitates the Impementation of legal guaranteesand mechanisms that ensure the constitutional courts independence and efficacy. One such measure could be the enactment of a law specific to the constitutional court, replacing previous internal of regulations that predominantly governed the constitutional council . the pimary question for consideration is; Is there a need to adopt a coprehhensive law for the constitutional court ? additionally, should there be a law on constitutional court? additionally, should there be a law on constitutional procedures? Is an unnecessary luxury or a legal necessity additionally, should there be a law on constitutional court? These inquiries are particularly pertinent as constitutinel already includes provisions relating to the adequacy of the constitutional councils internal regulationsand its transition to the constitutional court. ملخص: يعتبر الانتقال الدستوري من هيئة المجلس الدستوري الى نظام المحكمة الدستورية بموجب التعديل الدستوري الأخير لسنة 2020 متماشيا مع التحولات الدستورية اليوم في مجال الرقابة الدستورية ومعيارية القاعدة الدستورية، من الرقابة السياسية إلى الرقابة القضائية نحو العدالة الدستورية. وإذا كان البعض يرى في تجسيد المحكمة الدستورية من محاسنه الانتقال من قضاء رسميي نخبوي إلى "قضاء شعبي، فان ذلك يستتبع القيام بضمانات وميكانزمات قانونية تتيح للقضاء الدستوري ممارسة نشاطه بشكل من الاستقلالية من جهة والفاعلية في الجهة الثانية. ولعل من بين ذلك قانون للمحكمة الدستورية كبديل عن النظام الداخلي الذي كان ينظم في الغالب المجلس الدستوري سابقا. حيث السؤال الرئيسي المراد البحث فيه: هل هناك ضرورة لتبني قانون موحد للمحكمة الدستورية؟ ومن ثمة قانون للإجراءات الدستورية؟ هل هو ترف زائد أم ضرورة قانونية؟ خاصة وأن الدستور يضم في نصوصه بعض الإجراءات المتعلقة بالمحكمة الدستورية. زيادة على ذلك، طرح تساؤلات تتعلق بمدى كفاية النظام الداخلي للمجلس الدستوري؟ وانسحابه الى المحكمة الدستورية؟
