دور القضاء في تحقيق الأمن الأسري

الملخص
الملخص: تهدف هذه الورقة البحثية إلى بيان وتوضيح دور القضاء في إرساء دعائم وأسس الأمن الأسري من خلال وظائفه المختلفة كالعمل القضائي أو العمل الولائي، ومن خلال مؤسساته المكونة له والتي تتمثل على وجه الخصوص في قضاء الحكم وجهاز النيابة العامة وكذلك المحكمة العليا، حيث تم تسليط الضوء على أساليب وأدوات التدخل القضائي في المجال الأسري وبيان ما جاءت به القوانين الموضوعية والإجرائية الجديدة من أحكام، خاصة منها تعديل قانون الأسرة لسنة 2005، وإصدار قانون الإجراءات المدنية والإدارية سنة 2008. ثم حاولت هذه الدراسة الكشف عن العراقيل والصعوبات التي تعترض أداء المهام القضائية على أكمل وجه، أهمها عدم تأسيس قضاء أسري متخصص الذي أصبح ضرورة ملحة بالنظر إلى الطبيعة المتميزة للمؤسسة الأسرية. Abstract: This research paper aimes to highlight the role of the judiciary establishing the fondations and bases of family Security through its various fonctions such as judicial work or juridictional work, and through its constitutions including the judiciary the public prosecution as well as the suprême court. The paper sheds light on thé methods and tools of intervention in family matters and explains the provisions borough by the new substantive and procedural laws like amendement to the family law of 2005, and Civil and administrative procedures law of 2008. It also uncovers the most signifiant obstacles and difficulties that hinder the performance of judicial tasks to the fullest. Among which the establishment of specialized family justice has become an urgent necessity, considering the unique nature of the family institution.
