الملخص
تعد المحافظة على الرونق الجمالي والمتناسق في مجال البناء والتعمير من أبرز مظاهر التمدن والتحضر في أي مجتمع يتطلع الى الرقي والازدهار، وفي سبيل ذلك كان لزاما السعي الى التصدي لظاهرة البناء غير القانوني التي استفحلت وبشكل رهيب لدى أغلب المجتمعات مما ينعكس سلبا على تحقيق التنمية في شتى مجالاتها الأمر الذي أدى بالعديد من الدول الى رصد مجموعة من الآليات ضمن قوانينها الداخلية التي من شأنها المساهمة في الحد من تفاقم وتزايد فوضى العمران داخل المدينة والمشرع الجزائري كغيره من التشريعات أقر بتسوية وضعية البناء المخالف للقوانين بسنه آليات لتحقيق مطابقة البنايات وإتمام إنجازها من أجل تطهير الوضعية العقارية. One of the most important manifestations of urbanization in any society which aspires to advancement and prosperity is the maintenance of aesthetic and harmonious splendor in the domain of construction and reconstruction. To this end, it is imperative and necessary to address the phenomenon of illegal construction, which has worsened terribly in most societies and affects adversely development in many areas. This led many countries to monitor a set of mechanisms within their domestic laws that would contribute to reduce the aggravation and increase of urban chaos in the city. Like many legislations, the Algerian legislation approved the regularization of illegal construction by enacting provisions and mechanisms to achieve the conformity and completion of the buildings in order to clear the status of real estate and eliminate the negative appearences that have distorted the urban setting.
