تطبيق مبدأ الملوث الدافع يضمن تعويض الضرر البيئي

الملخص
الملخص: نظرا للتطور الذي شهده عالمنا المعاصر في شتى المجالات زادت مستويات التلوث على مستوى مختلف العناصر البيئية، مما أصبح من الضروري تدارك الوضع وإصلاح ما يمكن إصلاحه، وأمام عجز قواعد المسؤولية المدنية التقليدية في إحتواء الأضرار البيئية تعويضا، بحيث لم تحقق الحماية المطلوبة للمضرور، فكان لا بد من البحث عن أسس بديلة للخطأ لتعويض المضرور وفق توجه موضوعي أولى أولوياته تعويض المضرور. فسعي الفقه في هذا المجال أثمر عن أسس حديثة تتماشى وخصوصية الأضرار البيئية ، ولعلى من أهمها مبدأ الملوث الدافع، الذي له دور مزدوج دور وقائي يكمن في تحميل الملوث كل نفقات تدابير الوقاية والتقليص من التلوث، ودور إصلاحي علاجي يلتزم من خلاله الملوث بإعادة الأماكن وبيئتها إلى حالتها الأصلية. Abstract: Due to the development witnessed by our world nowadays in various fields, the levels of pollution increased in different environmental elements, which has become necessary to fix the situation and repair what can be repaired, and beside the inability of the rules of traditional civil liability in containing environmental damage compensation, in fact that the protection required for the victim was not achieved, so it was necessary to search for another foundations for the error to compensate the victim in accordance with an objective of his first priority to compensate the victim. The efforts made by jurisprudence in this field has resulted in modern foundations that match with the privacy of environmental damage, and the most important of them is the principle of the pollutant payer, which has a dual role, a preventive role that linkall charges to the polluter with all costs of prevention and reduction measures, and a reformist and remedial role which the polluter is committed to returning the places and their environment to original condition.
