قواعد التيسير ورفع الحرج في مناسك الحج عند المالكية – رؤية مقاصدية تأصيلية –

الملخص
هذا البحث يدور حول محورين رئيسين، يتضمن أولهما التأصيل الشرعي المقاصدي لقواعد التيسير ورفع الحرج عن المكلفين في أعمال الحج، والثاني؛ بيان ملامح الأبعاد المقاصدية لقواعد التيسير ورفع الحرج عند المالكية من خلال التمثيل ببعض النماذج التطبيقية لإثبات مرونة فقه الحج عندهم، في دفع الضرر عن المكلفين ومراعاة أحوالهم . هذا ويظهر أن قواعد التيسير ورفع الحرج يمكن نظمها في كليات ثلاث كالآتي: 1- قواعد التيسير ورفع الحرج الأصلي. 2- قواعد التيسير ورفع الحرج الطارئ لدفع الضرر بالتخفيف والترخص. 3- قواعد التيسير بالتدارك؛ وهي في حال فوت المشقة ووقوع المحظور، فجاءت لإتمام حجهم وتصحيحه وجبر الناقص منه بقواعد خصصت لذلك . Abstract: This research revolves around two main axes, the first of which includes the legal rooting of the objectives of the rules of facilitation and the removal of tax from the taxpayers in the work of Hajj, and the second is a statement of the features of the objectives dimensions of the rules of facilitation and the removal of embarrassment for the Malikis through the representation of some applied models to prove the flexibility of their jurisprudence of pilgrimage, in repelling damage from the taxpayers and considerate their conditions. This shows that the rules of facilitation and removal of embarrassment can be organized into three words as follows: 1- The rules of facilitation and lifting the original embarrassment. 2- Rules of facilitation and raising the emergency expense to pay damages by mitigation and authorization. 3- rules of facilitation by remediation; And it is in the event that the hardship and the prohibition are missed, so she came to complete their pilgrimage and correct it, and Jir I what is missing from it is the rules set aside for that.
