الملخص
لا يخفى على كل ذي لبٍّ أن التيسير ورفع الحرج مقصد عظيم من مقاصد الشريعة الإسلامية، وأصل مقطوع به من أصولها، وقد قام النبي -صلى الله عليه وسلم- بتجسيد هذا المقصد في الأحكام والتشريع والدعوة حتى أقبل الناس على دين الله أفواجا، واعتنقوه عن حب ورغبة، ولم يجدوا فيه أي حرج أو مشقة أو عنت، وسار على نهجه الصحابة الأبرار، فكانوا خير مثال في تجسيد التيسير في اجتهاداتهم وتطبيقاتهم، واقتفى الأثر بعدهم أئمة التابعين، وعلماء الفقه والأصول والقواعد. وعلى هذا الأساس تأتي هذه الدراسة لتتناول فقه التيسير ورفع الحرج من جانبين، جانب نظري: وفيه بيانٌ لحقيقته، وأن مبدأ التيسير ورفع الحرج أصل من الأصول التي بنيت عليه الشريعة الإسلامية، ومقصد عظيم من مقاصدها، مع الإشارة إلى الحكمة منه، والضوابط التي تحكمه وتصونه عن التشهي. وجانب تطبيقي: وفيه ذكر نماذج من فقه الإمام قتادة -رحمه الله- في أبواب الطهارة والصلاة والصيام؛ للدلالة على مدى تجسيده لهذا المبدأ الشرعي في آرائه الفقهية. On this basis, this study comes to deal with the jurisprudence of facilitation and lifting embarrassment from two sides, a theoretical aspect: And in it A statement of his truth, and that the principle of facilitation and lifting embarrassment is Origin From the assets on which the Islamic Sharia is built, and a great destination of its purposes. with reference to the wisdom of it, and the controls that govern and protect it from The appetite. And an applied aspect: and in it he mentioned examples of Imam Qatada's jurisprudence - may God have mercy on him - In the gates of purity, prayer and fasting, to indicate the extent to which he embodied this legal principle in his jurisprudential views.
