المسؤولية العقدية عن فعل الغير في القانون المدني المصري " دراسة مقارنة"

الملخص
تناولت هذه الدراسة المسؤولية العقدية عن فعل الغير في القانون المصري، وذلك من خلال التعريف في ، حيث في المبحث الأول منها، بما يشمله من تعريف هذه المسؤولية، وبيان شروطها ونطاقها والأساس القانوني الذي تم تأسيسها وتأصيلها استنادا له. تم تقسيم الدراسة إلى مبحثين تتناول الجانب النظري لهذه المسؤولية ، حيثما تناول الثاني احكام المسؤولية العقدية عن فعل الغير ومتى يتم تحققها والتعويض عنها ، وطرق دفع المسؤولية عن فعل الغير. توصلت الدراسة إلى مجموعة من النتائج أبرزها؛ ان للدائن حق الرجوع بموجب المسؤولية العقدية عن فعل الغير على المدين والغير معًا فتكون مسؤوليتها تضامنية ، ولعل أهمّ التوصيات ضرورة وضع قاعدة عامة للمسؤولية العقدية عن فعل الغير تتيح اقامة تلك المسؤولية في جميعالحالات التي تتوافر فيها شروطها، وعدم الاكتفاء بالنص على تطبيقات محدودة لتلك المسؤولية. الكلمات المفتاحية : المسؤولية العقدية – التعويض – فعل الغير – القانون المصري Abstract This study deals with the contractual liability in the Egyptian Act, through focus on significant of this topic by identify the contractual liability and explain the origination and legality of it. The study divided into two sections , section one deal with the theoretical aspect of this liability, while section two focus on the rules of contractual liability which should be full field when the breach of the obligation occurred by the third party and to determine the damages . The study conclude with numerous outcomes the most important of it the Creditor shall have right under the contractual liability to retain to third party to claim damages about the breach or wrongful act or contract also this will be subject to co-liability between debtor and third party, Moreover the study recommended to the necessity to provide for general rule which ensure the implementation of contractual liability.
