الملخص
نظرا لأهمية القضاء في حفظ النظام وحماية الحقوق، فمن الضرورة تفعيل مؤسساته وتحسين مستوى موظفيه لأجل إقامة العدل والحكم به على جميع أفراد المجتمع. وقد استعرض الباحث معالم القضاء في الفقه الإسلامي ببحث تعريفه وشروطه وتاريخه. وخلص إلى أن ولاية القضاء من أهم الولايات التي اهتمت بها دولة الإسلام بما تحققه من مقاصد حفظ الكليات الخمس. Given the importance of the judiciary in maintaining order and protecting rights, it is necessary to activate its institutions and improve the level of its employees in order to establish justice and rule by it on all members of society. The researcher reviewed the features of the judiciary in Islamic jurisprudence by examining its definition, conditions and history. He concluded that the mandate of the judiciary is one of the most important mandates that the Islamic State has paid attention to, as it achieves the objectives of preserving the five colleges.
