System For The Protection Of Confidentiality Under The 1993 Chemical Weapons Convention: Challenges Of Confidence And Effectiveness

Abstract

This study deals with the system for the protection of confidential information under the Chemical Weapons Convention of 1993, since it is one of the most important aspects addressed by the Convention as well as its crucial importance for effective verification of compliance with its provisions. States Parties and other stakeholders need strong safeguards to prevent the disclosure of confidential information and data circulating in the context of the implementation of the CWC, whether it relates to national security or to the business and chemical trade. Similarly, Member States should be assured that verification, on-site inspections and other monitoring and oversight bodies will not seek further relevant information, and that the information obtained will remain confidential if necessary. To ensure the protection of confidentiality, the Organization for the Prohibition of Chemical Weapons (OPCW) has established a strict system to regulate the handling of confidential information by the Technical Secretariat, establishing rules and regulations to classify the confidentiality of information and data provided by States Parties or collected by the OPCW, as well as the mechanisms necessary to protect such information, and address various potential violations. Although the CWC’s confidentiality protection system is a comprehensive and rigorous, the question remains about how effective it is in practical implementation and whether it actually responds to the concerns of States parties and stakeholders.
