النظام القانوني للمقاطعة الإدارية وعلاقتها بالجماعات المحلية

الملخص
- ملخص: المقاطعة الإدارية بيئة إدارية مستحدثة تندرج ضمن إطار المركزية الإدارية في صورة عدم تركيز إداري, أنشأها المشرع الجزائري في إطار التنظيم الإداري المحلي سنة 2015، في صورة ولايات منتدبة بموجب المرسوم الرئاسي رقم 15/140 والمرسوم التنفيذي رقم 15/141، تعمل تحت سلطة والي منتدب، حيث خصها المشرع الوطني بمهام معينة، تتقاطع في أغلبها مع المهام المنوطة بالدائرة, غير أن نظام المقاطعة الإدارية بقي محل جدل قائم حول وجودها القانوني الذي يكتنفه الكثير من الغموض، وذلك راجع لعدم تنظيمها بموجب قانون وإنما تم الإشارة إليها فقط في بعض المراسيم عن طريق الإشارة إلى رئيس الدائرة, وعليه فإن إنشاء مثل هذا الجهاز قانونًا يستوجب تحديد العلاقة القانونية التي تربطها بسائر الأجهزة المحلية وعلى وجه الخصوص الولاية. - Abstract : The administrative district is an evolving administrative environment that falls within the framework of administrative focusing in the form of a lack of administrative focus. Founded by the Algerian legislature within the framework of local administrative organization in 2015, in the form of mandates mandated by Presidential Decree No. 15/140 and Executive Decree No. 15/141, operating under the authority of a delegated Wali, where the national legislature assigned them to certain tasks, most of which intersect with the tasks entrusted to the Department. However, the administrative district system remained contentious about its legal existence, which is highly ambiguous, because it was not regulated by law but was referred to only in some decrees by reference to the head of the department. Thus, the establishment of such a body by law requires the determination of the legal relationship it has with other local organs, in particular the state.
