دور الضبط الإداري في تحقيق الحماية القانونية للهواء في التشريع الجزائري

الملخص
يعد موضوع البيئة من أكبر وأهم المواضيع التي تستدعي من الباحث الأكاديمي الاهتمام والعناية بشكل عام ومن الدولة بشكل خاص ممثلة في المشرع، ذلك أن المحافظة عليها تعتبر بمثابة المحافظة على الانسان والكائنات الحية الأخرى. إذ تتناول هذه الدراسة عرضا موجزا للحماية القانونية لمخاطر تلوث الهواء، بمختلف مصادره ووسائله، التي يزداد انتشارها يوما بعد يوم، والسبل الكفيلة بتخفيف هذا النوع من التلوث، باعتباره أهم وأخطر أنواع التلوث التي يعانيه الإنسان، جراء ارتفاع الاستخدام المتكرر والمتزايد لوسائل النقل بمختلف أنواعها، إلى جانب الوسائل الأخرى مما يؤثر سلبا على المحيط الذي نعيش فيه. Environmental subjects are considered one of the biggest and most debated topics which both attention and precision are generally required from the academic researcher and from the state specifically. And it is needed to be presented in the legislature himself. Preserving its importance is considered as important as preserving human life and other creators. The study presents a summary of the legal protection of air pollution’s defects with its various sources and means which are largely arising day by day and the useful ways for decreasing its effects, also considering the fact that it is the most dangerous kind of pollution that human life can endure as a result of the continuous overuse of its means repeatedly next to other means which all can affect negatively on the environment we are now living in.
