المقاصد الأصلية و التبعية لأحكام الأسرة وأثر رعايتها في الاجتهاد الفقهي (استئجار الأرحام نموذجا)

الملخص
هذا المقال محاولة لبيان جانب من جوانب أحكام الأسرة من منظور مقاصدي، ويتعلق الأمر بالمقاصد الأصلية والمقاصد التبعية، ومدى تأثيرها في القضايا الأسرية المعاصرة. تناولت فيه أولا مدخلا مفاهيميا، وذلك من خلال بيان مفهوم الأسرة، ومفهوم مقاصد الشريعة، وركزت فيه على الزوج المفهومي المقاصد الأصلية والمقاصد التبعية، ثم عرضت ثانيا لبيان مقاصد أحكام الأسرة الأصلية والتبعية، ووسائل المحافظة عليها من جانبي الوجود والعدم، وتطرقت في الأخير إلى قضية أسرية معاصرة وهي تأجير الأرحام في محاولة لدراسة جوانبها، وبيان مدى خدمتها للمقاصد الأصلية لأحكام الأسرة من عدمه. وقد خلصت هذه الدراسة إلى بيان جملة من المقاصد الأصلية والتبعية التي يتغياها الشارع في بناء الأسرة، والواجب يقتضي أن تفعل عند الاجتهاد الفقهي في النوازل المعاصرة.
