الضمانات الرقمية المستحدثة في قانون عصرنة العدالة رقم 15-03 حجية ثبوتية لإرساء أحكام التبليغ الالكتروني كمقترح إجرائي قضائي

الملخص
تجسدت الإرادة الحقيقة للمشرع الجزائري في تطوير قطاع العدالة بإصدار قانون رقم15-03 المتعلق بعصرنة العدالة والذي أرسى أولى اللبنات الأساسية التأصيليــة اللازمة للنهوض بقطاع العدالة من خلال تكريس أحكام تنظيمية و ضمانات رقمية والتي خلقت نتيجة تفاعل القانوني بالواقع المعتمد على وسائل الاتصال الالكتروني ورغبة من المشرع في استغلال مزايا هذا التطور لمنح مرونة وسهولة أكثر في إجراءات التقاضي . ومن خلال هذه الورقة البحثية سنحاول التعرض لدراسة الضمانات الرقمية في قانون المتعلق بعصرنة العدالة بالنظر في مدى قدرتها على إضفاء حجية ثبوتية لإرساء أحكام وقواعد للتبليغ الالكتروني كمقترح إجرائي قضائي بديل مبتكر يساهم في تطوير مهنة المحضر خصوصا وفي قطاع العدالة عموماً The true will of the Algerian legislator to develop the justice sector was embodied by issuing Law No. 15-03 related to the modernization of justice, which laid the first basic and fundamental building blocks necessary for the advancement of the justice sector by devoting regulatory provisions and digital guarantees, which were created as a result of the legal interaction with the reality that relies on electronic means of communication and the desire of the legislator to exploit the advantages of this development to grant more flexibility and ease in litigation procedures . Through this research paper, we will try to present the study of digital guarantees in a law related to the modernization of justice by looking at its ability to give evidentiary authority to establish provisions and rules for electronic notification as an innovative alternative judicial procedural proposal that contributes to the development of the bailiff's profession in particular and in the justice sector in general
