الملخص

ملخص: دعما لمشروع التّنمية في القطاع المؤسّساتي الوقفي نجد المشّرع دائما في سعي مستمر إلى مضاهاة التّجارب الرّائدة في إدارة الوقف وتطوير الأسس المؤسّساتية الوقفية لا سيما عندما يكون المرتكز الأساسي فيها هو الإدارة الفعّالة، لذا تمّ نقل الإشراف على الأوقاف من الإدارة الحكوميّة المباشرة )ممثلة في وزارة الشّؤون الدّينية والأوقاف( إلى " الدّيوان الوطني للوقف والزكاة " المستحدث مؤخراً(ماي2021)، والذي يُنتظر منه تسيير الأملاك الوقفيّة بما يضمن الرفع من كفاءتها الخدماتيّة والإسهام في التّنمية الاقتصاديّة. وتهدف هذه الورقة البحثيّة إلى بيان مدى استقلاليّة هذا الدّيوان من جهة، وكيفيّة إرساء وتفعيل معايير الجودة المؤسّساتيّة في آداءه من جهة أخرى، دون الإخلال بقواعد الحوكمة والاستثمار، خاصّة أن مهمّة التّسيير الكامل للأوقاف أصبحت موكّلة إليه. Abstract: In support of the development project in the institutional sector of the Endowments, we find the legislator in a continuous effort to bring together the pioneering experiences in the management of the Endowments and the development of the institutional foundations of the Endowments, in particular effective management. For this the management of the Endowments has been transferred from the direct government administration (represented by the Ministry of Religious Affairs and Endowments) to the new National Office of Endowments and Zakat (May 2021), which should manage the assets of the Endowments d in a way that guarantees greater efficiency in their service and contributes to economic development. This article aims to show the extent of the independence of this office on the one hand, and how to establish and activate the institutional standards of quality in its performance on the other hand, without violating the rules of governance and investment, d especially since he takes charge of Endowments management.
