نحو تحقيق لوجستيات التقاضي الإلكتروني في المحاكم القطرية: (دراسة مقارنة في ظل تشريعات مجلس التعاون لدول الخليج العربية)

الملخص
إن إبراز الجانب اللوجستي في تيسير إجراءات التقاضي الإلكتروني في المحاكم القطرية بما يعزز من تحقيق العدالة الناجزة، والوقوف على مدى إمكانية استخدام هذه التكنولوجيا في تيسير إجراءات التقاضي على الخصوم ووكلائهم وتيسير تسجيل الدعاوى والاطلاع عليها واتخاذ الإجراءات القضايا المتنوعة بسهولة وبما يكفل المحافظة على حقوق أفراد المجتمع من مواطنين ومقيمين أضح مسائل هامة في إرساء مبدأ العدالة، لاسيما وأن التشريعات القطرية قد ساهمت في تعزيز الجانب الإلكتروني في أنظمة العدالة وذلك من خلال اصدار القانون رقم (٢٤) لسنة ٢٠١٧ بشأن العنوان الوطني، والذي يسر المسائل ذات الصلة بها، وكذلك تنطلق أهمية هذه الدراسة وذلك لإثراء المكتبة القانونية بالبحوث والدراسات ذات الصلة بالتقاضي الإلكتروني في المحاكم القطرية بالمقارنة بتشريعات دول مجلس التعاون الخليجي، حيث لم نجد من قام بإبراز الخدمات الإلكترونية التي يقدمها المجلس الأعلى للقضاء في دولة قطر للجمهور والتطويرات الهائلة في أنظمتها بهدف القضاء على بطء إجراءات التقاضي وتوفير الوقت والجهد على الخصوم ووكلائهم وكذلك على القاضي من خلال الأنظمة الإلكترونية التي تم توفيرها له من أجل تصفح ملفات الدعوى واعتماد الأحكام القضائية ومحاضر الجلسات ومراجعتها إلكترونياً دونما الحاجة إلى تناولها ورقياً، حيث يهدف المجلس الأعلى للقضاء بدولة قطر إلى اعتماد ما يُسمى بــــــــ "محاكم بلا ورق Paperless Courts". Highlighting the logistical aspect in facilitating electronic litigation procedures in Qatari courts, in a way that enhances the achievement of prompt justice, and examining the extent to which this technology can be used to facilitate litigation procedures against litigants and their agents, facilitate the registration of lawsuits, review them, and take action on various cases easily, in a way that guarantees the preservation of the rights of members of society. Citizens and residents have clarified important issues in establishing the principle of justice, especially since Qatari legislation has contributed to strengthening the electronic aspect of justice systems through the issuance of Law No. (24) of 2017 regarding the national address, which facilitates related issues. The study is to enrich the legal library with research and studies related to electronic litigation in Qatari courts compared to the legislation of the Gulf Cooperation Council countries, as we did not find anyone who highlighted the electronic services provided by the Supreme Judicial Council in the State of Qatar to the public and the huge developments in its systems with the aim of eliminating the slowness of litigation procedures and saving time And effort on the litigants and their agents as well as on the judge through electronic systems that have been provided This is for him in order to browse case files, approve judicial rulings and session records, and review them electronically without the need to deal with them on paper, as the Supreme Judicial Council in the State of Qatar aims to adopt the so-called "Paperless Courts".
