جرائم تلوث البيئة بالنفايات الخاصة والخاصة الخطرة

الملخص
ملخص: تناولت الدراسة مشكلة النفايات الخاصة والخاصة الخطرة في القانون الجزائري من منظورها الجزائي، فتطرقت الى مفهوم هذا النوع من النفايات ومصادره، ثم عالجت الردع الجزائي الذي يضمن حماية البيئة في اطار التنمية المستدامة وفقا لأهداف المشرع الجزائري،فركزت الدراسة عل مفهوم الجريمة البيئية وعلى حصر الافعال المُجَرٍّمة لتلويث البيئة بالنفايات الخاصة والخاصة الخطرة، وناقشت الدراسة الجزاءات والتّدابير التي وضعها المشرع حماية للبيئة من التلوث بهذا النوع من النفايات، المُطبقة على الشخصين الطبيعي و المعنوي. وفي الأخير توصلت الدراسة الى انّه رغم الكمّ الهائل من القوانين التي وضعها المشرع لحماية البيئة من هذا النوع من النفايات الا انّه لم يُحقق الفعالية المطلوبة لمواجهة هذا النوع من التلوث، واقترحت مجموعة من الحلول . *** Abstract: The study dealt withe the problem of special and special dangerous waste in algeria law in terms of the penal law, the stady discussed the penalties and measures set by the legislator to protect the environment from pollution with this type of waste, applied to both physical and legal person. Finally,the stady concluded that the laws set by the legislator to protect the environment from this type of waste did not achieve the required effectiveness to confront this type of pollution, and it reached a set of solution. *** Résumé : L’étude a traité la problématique des déchets special et déchets spécial dangereux dans le droit algérien au regard du droit pénal, l’étude a abordé les sanctions et mesures fixées par le législateur pour protéger l’environnement de la pollution par ce type de déchets , appliqués aussi bien aux personnes physique qu’aux personnes moral. Enfin, l’étude a conclu que les lois établies par le législateur pour protéger l’environnement de ce type de déchets n’atteignaient pas l’efficacité requise pour faire face à ce type de pollution , et elle a abouti à un ensemble de solution.
