دور قواعد الشريعة والعرف في الوقاية من التفكك الأسري

الملخص
ملخص: قال تعالى: "وَإِنۡ خِفۡتُمۡ شِقَاقَ بَيۡنِهِمَا فَٱبۡعَثُواْ حَكَمٗا مِّنۡ أَهۡلِهِۦ وَحَكَمٗا مِّنۡ أَهۡلِهَآ إِن يُرِيدَآ إِصۡلَٰحٗا يُوَفِّقِ ٱللَّهُ بَيۡنَهُمَآۗ إِنَّ ٱللَّهَ كَانَ عَلِيمًا خَبِيرٗا " الآية 35 سورة النساء. تجسد الآية الكريمة النموذج الأمثل لكيفية التعامل مع النزاعات الزوجية بما يحقق غاية حلِّها من جهة و حفظ خصوصية للعلاقات الزوجية من جهة أخرى، و التي تواتر المجتمع الجزائري العمل بها فكانت بمثابة المحكمة التي تحافظ على شمل الأسرة، و حاول المشرع الجزائري أن لا يخرج عنها بتقنين الصلح كإجراء وجوبي قبل اللجوء لفك الرابطة الزوجية بموجب المادة 49 قانون الأسرة، لكن يبقى هذا البديل قاصراً عن تحقيق النتائج المرجوة في ظل الذهنية المترسخة لدى معظم المجتمع الجزائري تجاه القضاء، وأنّ الوقوف بأروقته لحل المشاكل الزوجية ما هو إلاّ تعكير لها، بحيث يصبح نجاح الصلح ظرفياً، و يبقى احتمال الشقاق قائماً. Abstract: llah Almighty said "If you fear a split between the two of them, then appoint an arbiter from his relatives and an arbiter from her relatives. If they desire reconciliation, Allah shall reconcile them "verse 35 AN-NISSA. This verse is the most perfect model of how to deal with marital disputes, Thus to achieve a solution on one hand and to protect the marital relationships privacy on the other hand. This is a frequency that the Algerian society works with it. So it was as a court that keeps the family unity, also the Algerian legislator tried not to deviate from it by rationing reconcile as an obligatory procedure before resorting to break of the marital bond under the article 49 of the family law. However, it still remains a limited alternative for achieving the wanted results in the light of the entrenched mentality in the most of the Algerian society towards the judiciary and standing in its corridors to solve marital problems is nothing but a disturbance to it. So that the success of reconcile becomes circumstantial and the possibility of the split remains
