الملخص

الدّلالة الوضعيّة وأثرُها في توجيه مسائل الفروع عند المالكيّة [آيةُ الوضُوء نموذجاً] ملخص يلقي هذا البحث الضوء على أثر الدلالة الوضعية في مسائل الوضوء عند المالكية من خلال آية الوضوء، وذلك باستخراج المسائل الفقهية المستنبطة منها وما لها من التوجيهات اللغوية، وهو يجمع بين المنهج الاستقرائي والوصفي والتحليلي، ويقوم بناؤه على مقدمة وثلاثة مباحث، يتناول المبحث الأول منها تعريف الدلالة الوضعية وأثرها في فهم النص الشرعي، ويتناول المبحث الثاني مسائل الوضوء، ويتطرق المبحث الثالث إلى مسائل التيمم، وقد خلص البحث إلى أن آية الوضوء على وجازة ألفاظها تحمل الكثير من أوجه الدلالات، وإلى وجوب غسل المرفقين، ودخول الدلك في ماهية الغسل، وأن التيمم جائز بما سوى التراب من أجزاء الأرض التي يصدق عليها اسم الصعيد، وأنه لا يجوز التيمم قبل دخول وقت الصلاة، وغير ذلك المسائل التي يعضد التوجيه اللغوي فيها مذهب المالكية. الكلمات مفتاحية: أثر، الدلالة، الوضعية، المالكية Positive significance And its impact on directing the issues of the branches of the Malikis [The ablution verse as an example] summary This research sheds light on the effect of Situational indication on the issues of ablution (Wudu) for the Malikis through the verse of ablution, by extracting the jurisprudential issues derived from it and its linguistic directives. It combines the inductive, descriptive, and analytical approach. It is composed of an introduction and three topics, the first topic deals with the definition of situational indication and its impact on understanding the legal text, the second topic deals with ablution issues, and the third topic treats the issues of tayammum. The research concluded that the verse, even though summarized, its words carry many aspects of indications. These include the obligation of washing the elbows, the inclusion of rubbing in the nature of washing, that tayammum is permissible with things other than sand from the parts of the earth on which the name al-Sa`id applies, that it is not permissible to do tayammum before entering the time of prayer, and other issues in which linguistic guidance is supported by Maliki doctrine.
