الملخص

الملخص: أسس رولز للعدالة على نحو تعاقدي من خلال مفهوم الوضع الأصلي الذي يتموضع فيه الأشخاص تحت حجاب الجهل ، والذي يجهلون بموجبه موضعهم المستقبلي داخل المجتمع الجديد ،حيث يكونون على دراية بالشؤون العامة للحياة السياسية ويجهلون الخصوصيات الجزئية ،وبعد مناقشتهم للمبادئ المختلفة في تاريخ الفكر السياسي ،ينتهي المشتركون الى الاتفاق على مبدإ الحرية المتساوية للجميع ومبدإ الاختلاف المبرر لبعض التفاوتات المشروطة بإنتاج الفوائد للواقعين عند العتبة السفلى في المجتمع . وما يميز هذه المبادئ التي يقترحها رولز هي استراتيجيته الكانطية في صياغتها حيث تكون ضرورية وثابتة وعلى أساس أخلاقي يمكن من خلالها الحد من تسارع النفعية والقصر من تبريرات العدالة على نحو نفعي ،ويؤكد بذلك رولز على أولوية العادل على النافع مع الإبقاء على النافع. وتكون هذه المبادئ بمثابة الأساس القاعدي للمجتمع الجديد وترسي بذلك قواعد الاحترام المتبادل وقيم التعاون . Abstract: Rawls's foundations of contractual justice through the concept of the original situation i.e people are placed under the veil of ignorance, where they are familiar with the general affairs of political life and ignorant of the partial specifics, and after their discussion of the various principles in the history of political thought, it ends The participants agreed on the principle of equal freedom for all and the principle of justified difference for some disparities that are conditional on the production of benefits for the realists in the lower level of society What distinguishes these principles is the Kantian strategy in formulating them where they are necessary, constant and on an ethical basis through which the acceleration of utilitarianism and the shortage of justifications for justice can be minimized in a beneficial manner, and thus Rawl stresses the primacy of the just over the beneficial. These principles are the basic foundation for the new society and thus lay down the rules for mutual respect and the values of cooperation.
