الملخص
الملخص: جريمة الغدر إحدى صور جرائم الفساد الخطيرة الماسة بنزاهة الوظيفة العامة والتي تمارس في معرض قيام الموظف العام بواجباته المهنية، فالغدر نعت من سلوك الموظف في طلب أو أخذ ما ليس مستحقا من الضرائب والرسوم أو تجاوز ما هو مستحق قانونا، وبالنظر لما يترتب على هذا المساس من تهديد للدولة وكياناتها ومؤسساتها بسبب سوء الاستغلال والمتاجرة بالوظيفة من طرف بعض الموظفين هذا من جهة، وحماية لمبدأ دستوري هام وهو مبدأ قانونية الضرائب والرسوم، كما أن كل المواطنين متساوون في أداء الضريبة من جهة ثانية، هذا ما دفع بالمشرع الجزائري إلى تجريم فعل الغدر والعقاب عليه بموجب المادة 30 من القانون رقم:06-01 المتعلق بالوقاية من الفساد ومكافحته، وبالتالي يتعرض كل موظف عام للمسؤولية الجزائية متى ثبت ضده ارتكابه جريمة الغــــدر. Abstract : The crime of treachery is one of the forms of serious corruption crimes that affect the integrity of the public office, which is practiced in the context of the public employee carrying out his professional duties. A threat to the state, its entities and institutions due to abuse and job-trafficking by some employees on the one hand, and protection of an important constitutional principle, which is the principle of the legality of taxes and fees, and that all citizens are equal in paying taxes on the other hand, this is what prompted the Algerian legislator to criminalize the act of treachery and punish it According to Article 30 of Law No: 06-01 related to the prevention and control of corruption, and therefore every public employee is subject to criminal responsibility if it is proven against him that he committed the crime of treachery.
