حماية المرأة من العنف بين الآليات التشريعية في الفقه الإسلامي والقانون المقارن والتناول الاعلامي

الملخص
مثّل العنف ضد المرأة معضلة اجتماعية وأخلاقية رافقت المجتمعات عبر عصورها، فتوجهت التشريعات على اختلاف مرجعياتها لإيجاد حل لها، وكذا لوضع حدّ لتوسعها خصوصاً مع تطور المدنية؛ ويظهر في هذا الميدان ثلاث مجالات حاولت مقاومة العنف ضد المرأة، وهي التشريع الإسلامي، وكذا القوانين الدولية والوطنية، والمجال الثالث الإعلام بمختلف مؤسساته ووسائله؛ وقد اعتمد كل مجال على آليات وأسس حاولت من خلاله معالجة المشكلة، وسواء اتفقت هذه المجالات في بعض المنطلقات والآليات أم اختلفت، فإنّ المعتبر في هذا مدى جدوى ونجاح كل محاولة في تقليص دائرة العنف. فتتبع هذا الآليات والأسس المعتمدة قد يضعنا أمام صورة واضحة تجلي لنا مدى جدية كل محاولة، ومدى نجاحها في مقاومة العنف ضد المرأة، خصوصاً في ظل توسع دائرة تعنيف النساء، وكذا أخذا بعين الاعتبار كون الظاهرة معقدة بشكل يجعل معالجتها أو محاولة التقليص منها أمر صعب؛ فبيان الأسس التي اعتمدتها الشريعة الإسلامية وكذا القانون وكذا الإعلام، قد يعطينا تصوراً متكاملا لما من شأنه أن يحمي المرأة، على أن محاولة صياغة نظرة تجمع بين ضوابط الشريعة وصرامة القانون وسلاسة الإعلام قد ينجح في تحقيق المراد في العصر الحاضر. Violence against women was a social and moral dilemma that accompanied societies throughout their eras, so legislation, regardless of reference, tended to find a solution to it, as well as to put an end to its expansion, especially with the development of civilization. Three areas appear in this field that tried to resist violence against women, namely Islamic legislation, as well as international and national laws, and the third area is the media in its various institutions and means. Each field relied on mechanisms and foundations through which it tried to address the problem. Whether these areas agreed in some starting points and mechanisms or differed, what is considered the feasibility and success of each attempt to reduce the cycle of violence. Following these mechanisms and the foundations adopted may put us in front of a clear picture that shows us the seriousness of each attempt, and its success in resisting violence against women, especially in light of the expansion of the circle of violence against women, as well as taking into account the fact that the phenomenon is so complex that makes it difficult to address or try to reduce it difficult. Explaining the foundations adopted by the Islamic Sharia, as well as the law and the media, may give us an integrated vision of what would protect women, although an attempt to formulate a view that combines the controls of the Sharia and the strictness of the law and the smoothness of the media may succeed in achieving the goal in the present era.
