الملخص
الملخص عالجت الدراسة المركز القانوني للمؤسس في شركات المساهمة وبينت أن معنى المؤسس تتنازعه اتجاهان، اتجاه يوسع من معناه واتجاه يضيق من هذا المعنى، كما بينت الآراء الفقهية التي قيلت في تفسير طبيعة علاقة المؤسس بالشركة تحت التأسيس وتبنت الاتجاه الذي يعتبر الشركة تحت التأسيس تتمتع بالشخصية المعنوية بالقدر اللازم للتأسيس. Abstract: The study addressed the legal status of the founder in joint-stock companies and showed that the meaning of the founder is conflicted by two directions, a trend that expands its meaning and a narrow trend of this meaning, We also indicated the jurisprudential opinions that were said in explaining the nature of the founder’s relationship with the company under incorporation and adopted the trend that considers the company under incorporation to have the legal personality to the extent necessary for incorporation.
