مقومات الأمن القانوني: تعزيز لاستقرار العقد

الملخص

ظهرت الحاجة الماسة إلى تحقيق الأمن القانوني بعد ظهور عدة عوامل أثرت على استقرار المراكز القانونية، حيث أن عدم ثبات التشريع وعدم الوضوح في بعض قواعده أدت إلى المساس بالحقوق التي يسعى التشريع إلى حمايتها، وبعد وضع عناصر يقوم عليها الأمن القانوني، ذهب رأي من الفقه إلى أن تلك العناصر ينفرد بها القانون العام، وقد لا تصلح لتطبيقها على قواعد العقد لاختلاف طبيعة المبادئ التي تحكم القانونين، غير أن الحاجة إلى إعمال عناصر مبدأ الأمن القانوني تقود إلى البحث عن مدى ملاءمة تلك العناصر لمتطلبات استقرار العقد للوصول إلى الأمن التعاقدي وتحقيق استقرار المراكز التعاقدية. الكلمات المفتاحية: الأمن القانوني، عناصر الأمن القانوني، العقد، استقرار العقد. Abstract: The urgent need to create legal security is a result of several factors which affected the stability of legal centres. Since the instability of legislation and the vagueness of some of its rules lead to infringing the rights that legislation seeks to protect. After setting the elements which constitute law security, a jurisprudential view expressed that those elements are unique to the common law, and as such, it is not possible to apply them on the law of contract given the different nature of principles ruling both laws. However ; the need to validate the elements of law security leads to the search of the suitability of those elements to the requirements of the contract stability in order to ensure the contractual security and stabilize statuses.
