مظاهر حماية حقوق الإنسان وحرياته في الشريعة الإسلامية

الملخص
إن الله عزَّ وجلَّ جلت حكمته جعل الشريعة الإسلامية منهجًا، متكاملاً للحياة الإنسانية سواء أكان ذلك على مستوى الفرد، أو الجماعة ، وضمَّنها من القواعد والأحكام ما جعلها صالحة للحياة البشرية في كل الأزمنة، والأمكنة والعصور، ومهما تطورت الحياة البشرية، وتغيرت ظروفها، فإن في الشريعة الإسلامية حلولاً لكل مشاكلها. ولذلك تهدف هذا الدراسة إلى بيان نظرة الشريعة الإسلامية إلى القضايا التي اسالت عليها المواثيق الدولية، والمنظمات حبرًا كثيرًا، وانعقدت لها مؤتمرات، ونصت عليها الدساتير، وسنت لها قوانين ألا وهي حقوق الإنسان وحرياته، التي نصت عليها الشرائع السماوية، وجاءت الشريعة الإسلامية باعتبارها خاتمة الشرائع السماوية بالدعوة إلى احترام هذه الحقوق، والحريات، وصيانتها، ورصدت لمن يعتدي عليها عقوبات شديدة. Summary: God has rewarded and all his wisdom has made Islamic law a curriculum, integral to human life, whether it be at the level of the individual, or the group, guaranteeing it rules and provisions that make it fit for human life in all times, places and ages, and no matter how human life evolves, and its circumstances change, the Islamic Shariah has solutions to all its problems. The study therefore aims to reflect the Islamic sharia's view of the issues that have been asked by international instruments, organizations, conferences, constitutions, laws that have been enacted, namely human rights and freedoms, which are enshrined in the heavenly laws. The Islamic sharia as the conclusion of the divine laws calling for respect for these rights, freedoms, and the maintenance of these freedoms, and monitoring of those who violate them with severe penalties.
