تخريج الفروع الفقهية على الأصول النحوية - دراسة وصفية تطبيقية -

الملخص
إنّ معاني النصوص من آيات وأحاديث أحكام لا تفهم على صحة إلاّ بتوفيتها حقوقها من الإعراب، وهوما تتولاّه المبادئ النحوية، إذ بها تتبيّن أصول المقاصد بالدلالة، وعليها تتخرّج جملة ليست باليسيرة من المسائل الفرعية التي لا يتبيّن وجه الدلالة من الكثير منها إلا بابتنائها على أصول نحوية، ومعرفتها- أي المبادئ النحوية- شرط لمن تصدّى للإفتاء، وشرط من شروط الاجتهاد؛ فمن لا يهتدي إلى وجه الارتباط بين أحكام الفروع وأدلتها التي من بينها أصول النحو، لا يتسع له المجال، ولا يمكنه التفريع عليها بحال. إنّ فنّ تخريج الفروع الفقهية على الأصول النحوية سليل علم تخريج الفروع على الأصول الفقهية، قد يستقل بذاته عنه كما استقل هو بذاته عن علمي أصول الفقه والفقه؛ فموضوعه إذن موضوعه، وكذا الأركان والشروط، ولا تخفى أهميته على ذي لب. Abstract : The meanings of the texts from the verses and the hadiths of rulings are not understood as valid until they have fulfilled their rights of expression, this is what grammar principles do, as it identifies the sources of the purposes by meaning, And they link many of the jurisprudential issues that can not be identified by the significance of many of them but the coptain of the grammatical principles, And knowledge of any grammatical principles is condition of those who have addressed the fatwa and a condition of ijtihad. It is not guided to the correlation between the provisions of the practical legal decisions and their evidence, including the assets of grammar, it has no room and can not divide it in any way, the art of Linking Practical Legal Decisions to Governing Grammatical Sources is a descendant of the science of Linking Practical Legal Decisions to Governing legal Sources(takhrij al- furu ala al- usul al- fiqhia), may be independent of himself as he himself is independent of the knowledge of the principles of jurisprudence and jurisprudence , so his subject matter, As well as the elements and conditions, And its importance is not hidden on the core.
