الحرب ضد الإرهاب وتداعياتها على مبادئ القانون الدولي

الملخص
ملخص: أدرك المجتمع الدولي الخطر الذي يهدد الدول جراء تصاعد الأعمال الإرهابية، باعتبارها من أخطر الجرائم المؤثرة على الأمن القومي، والتي أصبحت تمثل انتهاكا صارخا لحقوق الإنسان، وتهدد المصالح الحيوية للمجتمع الدولي في ظل التبعات التي بات يعانيها جريمة الإرهاب، فقد اهتمت منظمة الأمم المتحدة بمكافحة الإرهاب منذ نشأتها، وفي ظل ذلك أعلنت الولايات المتحدة الأميركية الحرب على الإرهاب بعد الهجمات التي شُنّت عليها في الحادي عشر سبتمبر2001 وقامت بعمليات عسكرية على ادعت مساندته الإرهاب الدولي، مرتكزة على أسس قانونية بما فيها حق الدفاع الشرعي، والتدخل باسم الشرعية لمكافحة الإرهاب الدولي. علما بأن الدول الكبرى قد وظفت مصطلح مكافحة الإرهاب أداة ضغط من أجل فرض سياساتها،وتحقيق مصالحها الخاصة، منتهكة في ذلك أحكام القانون الدولي باسم حقوق الإنسان سواء فردية كانت أو جماعية. Abstract: Consequences of the use of force in the fight against terrorism on human rights The international community has become aware of the danger posed to States by the escalation of terrorist acts that have become a violation of human rights. and threaten the vital interests of the international community. As a consequence of the consequences suffered by the international community as a result of terrorism, the United Nations has been preoccupied with the fight against this scourge since its foundation. For this purpose, the United States of America declared the war on terrorism after the attacks of September 11, 2001, by launching military operations against states that declared their support for international terrorism on the basis of legal foundations, among others the right of self-defense and intervention in the name of the legitimacy of the fight against international terrorism. Only large states have used the fight against terrorism as a means of pressure to impose their policies and the realization of their particular interests by violating the principles of international law and individual or collective human rights
