أثر القواعد النحوية في المسائل الفقهية دراسة تطبيقية على باب الطلاق

الملخص
يسعى هذا البحث إلى إثبات أثر قواعد النحو في استنباط أحكام مسائل الفقه؛ من خلال: إبراز اهتمام علماء الفقه الإسلامي بعلم النحو، حيث اشترطوا إتقان علوم اللغة العربية، وفي مقدمتها علم النحو؛ لاستنباط الأحكام من النصوص الشرعية. والقيام بجمع القواعد النحوية الموجودة في باب الطلاق من الكتب الفقهية، وتنسيقها في عشرة مباحث نحوية، وترتيبها على ترتيب ألفية ابن مالك، وتوضيح كيفية توظيف الفقهاء لتلك القواعد النحوية في استنباط أحكام المسائل الفقهية لهذا الباب. وقد توصل البحث إلى نتائج متعددة، منها: اهتمام كبار فقهاء الأمة بعلوم اللغة العربية، وفي مقدمتها النحو، كما أن بعض الفقهاء يحاسبون الناطق بألفاظ الطلاق بمقتضى قواعد النحو وإن لم يكن عارفاً بها؛ لأنه يجب أن يعلمها، وقد شرح الفقهاء عدداً من قواعد النحو واعتمدوا بعض الآراء النحوية أثناء بيانهم لأحكام مسائل الطلاق. This research seeks to demonstrate the impact of grammar rules on the development of jurisprudence issues by: Highlighting the interest of numerous Islamic scholars in grammar, where they require mastery of Arabic language sciences, primarily grammar, to derive judgments from islamic texts. Collecting the grammatical rules in the divorce section from the jurisprudential books, by coordinating those rules in ten grammatical investigations, and arranging them following the order of 'Alfiat Ibn Malik', and explaining how scholars have used those grammatical rules in order to derive various provisions related to the doctrinal issues of this section. This research has reached to multiple conclusions. It has emphasized the significant role which was played by scholars in Arabic language, specifically grammar and syntax. The scholars have also considered that individuals are accountable for the words of divorce under the rules of grammar, even if they are not fully aware of its consequences or its implicit meanings. The scholars in this field have also explained a number of grammar-related rules and adopted some grammatical views during their commenting on the provisions of divorce issues.
