مبدأ الحياد في الوظيفة العامة The Principle Of Neutrality In The Civil Service

الملخص
إذا كان الفقه قد اتفق حول ضرورة مبدأ الحياد في الوظيفة العامة، فالشيء الذي لم يتفق عليه هو درجة هذا الحياد، فهناك من يرى اطلاق مبدأ الحياد فالموظف العام يجب أن لا يتأثر بكل الضغوطات، ويتجرد من الحقوق السياسية ويفضل المصلحة العامة على المصلحة الشخصية، ولضمان مبدأ الحياد يجب توفر حماية الموظف، وتنظيم الوظيفة العمومية بحمايتها من التدخلات والضغوطات التي تمارس عليها من العناصر الخارجية، وعلى هذا الأساس يجب على الموظف أن يلتزم بأداء واجباته في نطاق ما تقضي به الوظيفة العامة، كالتزامه بطاعة الأوامر الرئاسية لان واجب الطاعة أمر مفروض تمليه قوانين وطبيعة الوظيفة العامة، وهو الركن الرئيس في استمرارية المرفق العام، كما يجب ان يلتزم الموظف العمومي بواجب التحفظ في سلوكه العام وارتباطه بعدم ممارسة أي عمل يخدش كرامة الوظيفة العمومية أو مهنته، او المرفق الذي يعمل به. إذن فالحياد في حقيقته شكل من اشكال وجود الدولة، بكل ماتعني هذه الحالة من فلسفة قانونية، أو اجتماعية، او سياسية، أو اقتصادية، وما تتطلب من تظافر كل الجهود وكل الطاقات دون استثناء، ومزج كل المبادئ، فهو بمثابة مشروع بحث عن الإتقان المستمر لفكرة الدولة الشفافية. Abstract: If the jurisprudence has agreed on the necessity of the principle of neutrality in the civil service, what was not agreed upon is the degree of this neutrality. there are those who see the launch of the principle of neutrality the public servant should not be affected by all pressures, and stripped of political rights the public interest is preferred over the personal interest, and to ensure the principle of impartiality employee protection must be in place. and the organization of the public office by protecting it from interference and pressures practiced by them from external elements, basing on this the employee must be committed to performing his duties within the scope of the public office, as his obligation to obey presidential orders because the duty to obey is imposed dictated by the laws and the nature of the public office, it is the main pillar in the continuity of the public facility, the public servant must also abide by the duty of discretion in his general behavior and its association with not doing any work violates the dignity or profession of the public office, or the facility in which it works. therefore, neutrality is, in fact, a form of statehood. in all the legal philosophy of this case, Or social, or political, or economical, and what requires concerted all efforts and all energies without exception, and blending all principles, it is a research project on the continuous perfection of the idea of the state.
