Droit D’ingerence Ecologique: Un Nouveau Filon Interventionniste

Résumé : Cet article questionne les principes de légitimation du droit d’ingérence écologique, en partant de l’hypothèse que le processus de développement du pouvoir de la société internationale sur les souverainetés nationales pourrait être étendu à la défense des enjeux environnementaux, et trouver le moyen de contourner les règles ou de devenir l’exception à ces règles. Dans cet article, nous nous sommes focaliser sur Trois principes : le droit de l’homme à un environnement sain, la responsabilité globale de l’homme à l’égard du milieu naturel des générations présentes et futures, et enfin, la consécration du patrimoine commun de l’humanité sur certaines zones ou/et le partage acceptable de compétences dans la gestion de certains territoires. ملخص: يناقش هذا المقال مبادئ التشريع في مجال حق التدخل البيئي انطلاقا من افتراض ان مسار تطور قدرة المجتمع الدولي على سيادة الدول يمكن ان يوسع المجال الى الدفاع على الرهانات البيئية وإيجاد الوسائل الكفيلة لتجاوز القواعد ا وان يصبح استثناء للقوانين. نركز في هذا المقال حول ثلاثة مبادئ أساسية: حقوق الإنسان في بيئة نظيفة، المسؤولية الجماعية للفرد تجاه الاستدامة البيئية التي تكفل حقوق الأجيال الحالية والمستقبلية. وأخيرا معالجة التراث المشترك للإنسانية حول بعض المواقع والأقاليم أو تسييرها بشكل مشترك من قبل الكفاءات المتكاملة. Abstract: This article aims to discuss the principles of legitimacy of ecological interference right, starting from the hypothesis that the process of developing the power of international society over national sovereignties could be extended to the defense of environmental issues, and find a way to bend the rules or become the exception to those rules. These principles legitimizing interference for ecological purposes, are grouped around three principles: the human right to a healthy environment, the global responsibility of man with regard to the natural environment of present and future generations, and finally, the consecration of the common patrimony of humanity in some areas and/or the acceptable sharing of proficiency in the management of some territories.
