إشكالية التمييز بين الإرهاب والمقاومة المسلحة وفق قواعد القانون الدولي

الملخص
تهدف هذه الورقة البحثية إلى التعريف بموضوع الإرهاب والمقاومة المسلحة والذي يشهد تنوع وتضارب العديد من المفاهيم، وتطرقنا إلى إشكالية مفادها ماهي الحدود الفاصلة للتمييز بين الإرهاب والمقاومة المسلحة وفق منظور قواعد القانون الدولي ؟ وتم إستعمال المنهج الوصفي حيث توصل الباحث إلى أن المفهومين يتسمان بصعوبة تحديد الفروق بينهما، وذلك بسبب توظيفهما من قبل الدول والمنظمات الدولية, تبعا لاعتبارات سياسية مصلحية بعيدا عن قواعد القانون الدولي و المعايير الموضوعية في المواثيق و الاعراف الدولية. this research paper aims to introduce the issue of terrorism and armed resistance, which witnesses the diversity and conflict of many concepts, and we touched on the problem of what are the boundaries to distinguish between terrorism and armed resistance according to the perspective of the rules of international law? The descriptive approach was used, where the researcher concluded that the two concepts are difficult to determine the differences between them, because of their employment by states and international organizations, according to political interest considerations away from the rules of international law and objective standards in international charters and norms.
