دور النيابة العامة في دعاوى الجنسية وفقا للتشريع الجزائري

الملخص
ملخص: تعتبر مسألة الجنسية ذات أهمية بالغة في حياة الفرد و المجتمع لما يكتسيه الطابع الرسمي لها وما ترتبه من حقوق و التزامات للدول و الافراد ،الأمر الذي قد يثار بشأنها منازعات من حيث اثباتها او الغاء عن الأشخاص و الجدل القائم حول مدى جواز رفع دعوى قضائية للإثبات تمتع الشخص من عدمه بالجنسية أمام القضاء المدني، بحيث يطرح التساؤل حول دور النيابة العامة بصفتها تمثل الحق العام و النظام العام في مثل هذه الدعوى في ظل نطاق قانون الجنسية الجزائري ،ومن ثمة كان من المتعين البحث في هذا الموضوع من خلال التطرق الوثائق المطلوبة في اكتساب الجنسية الجزائري وفقا لقانون الجنسية الجزائري ،و طرق اتصال قسم شؤون الأسرة بمنازعات المتعلقة بإثبات أو نفي الجنسية عن الأشخاص، مع تبيان أليات طعن فيهاو تنفيذ أحكام الصادرة فيها من جانب النيابة العامة ، والبحث عن الإشكالات التي لا تزال تقيد النيابة العامة في القيام بدورها على في هذه المنازعة، و العقبات القانونية التي تحد من فعاليتها في هذه الخصومة. Abstract: The issue of nationality is of great importance in the life of the individual and society due to the official nature of it and the rights and obligations it entails for states and individuals. Whether or not the person has citizenship before the civil judiciary, so that the question arises about the role of the Public Prosecution as representing the public right and public order in such a case under the scope of the Algerian Nationality Law, Hence, it was necessary to research this subject by addressing the documents required for the acquisition of Algerian nationality in accordance with the Algerian Nationality Law, and the ways in which the Family Affairs Department contacts disputes related to the establishment or denial of nationality from persons, with an explanation of the mechanisms for appealing it and implementing the rulings issued in it by the prosecution Public Prosecution, and the search for the problems that still restrict the Public Prosecution from playing its role in this dispute, and the legal obstacles that limit its effectiveness in this litigation.
