الرقابة الادارية القبلية لرئيس المجلس الشعبي البلدي في مجال البناء والتعمير

الملخص

رئيس المجلس الشعبي البلدي مكلف بحماية النظام العام على مستوى اقليم البلدية في عدة ميادين ومنها مجال العمران حيث يسهر على تطبيق القانون من خلال القيام بالصلاحيات المخولة له كضابط إداري بموجب قانون البلدية أو بموجب النصوص القانونية والتنظيمية ذات الصلة بالبناء والتعمير، فهو يقوم بدور اساسي بإعداد أدوات التعمير وممارسة الرقابة ولاسيما القبلية منها على النشاط العمراني عن طريق اصدار مختلف الرخص والشهادات المتعلقة بالبناء والتعمير . يهدف هذا الموضوع الى توضيح الضوابط التي يخضع لها النشاط العمراني بداية من أدوات التهيئة والتعمير ثم اجراءات وشروط الحصول على رخص وشهادات التعمير ، ومدى السلطات التي يتمتع بها رئيس المجلس الشعبي البلدي في كل ذلك بغرض الحد والقضاء على ظاهرة البناء العشوائي ، وتبيان الآليات القانونية للرقابة البلدية القبلية على أشغال التعمير وما يترتب عن ذلك من آثار مع بيان مختلف النصوص القانونية المتعلقة بمهام رئيس المجلس الشعبي البلدي كضابط اداري للنشاط العمراني قبل مباشرة أشغال البناء، والتي تبوؤه مكانة وسلطة من خلالهما تعول عليه الدولة في حمايته للنظام العام العمراني . Abstract: The head of the Municipal People’s Council is charged with protecting public order at the level of the municipality’s territory in several fields, including the field of urbanization, where he ensures the implementation of the law by carrying out the powers granted to him as an administrative officer under the municipal law or under the legal and regulatory texts related to construction and reconstruction. He plays a key role in preparing construction’s tools and exercise control, especially prior one, on urban activity by issuing various licenses and certificates related to construction and reconstruction. This topic aims to clarify the controls to which the urban activity is subject, starting with the preparation and construction tools, then the procedures and conditions for obtaining construction licenses and certificates, and the extent of the powers enjoyed by the President of the Municipal People’s Council in all of this with the aim of limiting and eliminating the phenomenon of random construction, and clarifying the legal mechanisms for the prior municipality control on the construction works and the consequent effects, with a statement of the various legal texts related to the tasks of the President of the Municipal People’s Assembly as an administrative officer of the urban activity before starting the construction work, which occupies a position and authority through which the state relies on him to protect the urban public order.
