الملخص
في هذا المقال تناولنا جزئية من براءات الاختراعات في إطار أمر 03/07 الخاص ببراءات الاختراع في التشريع الجزائري ألا وهي الاختراعات المستثناة من الابراء لما لها من أهمية للمخترع إذ لا يجب عليه أن يضيع عصارة تفكيره ووقته في اختراعات خارجة عن الابراء ، وهذا لما له من أهمية للباحث والقانوني في الاطلاع على هذه الاستثناءات ولما لها من أهمية للإداري والقضائي حيث الفصل في طلبات شهادة الابراء ، وقد تناولنا هذا الموضوع من خلال المادتين 7و8 من أمر 03/07 وسلطنا عليها الضوء بالتحليل والمناقشة في جزئيتين:الأولى: الاختراعات غير المبرأة بحسب الموضوع والجزئية الثانية: الاختراعات الخارجة عن الابراء بسبب خارجي يتعلق بالبيئة ويمس بالآداب العامة والنظام العام. وخلصنا إلى نتائج واقتراحات في الأخيــــــر.
