النظام القانوني للحالة المدنية في ظل قانون 17-03

الملخص
إن نظام الحالة المدنية في الجزائر عرف تطورا تشريعيا كبيرا منذ إصدار قانون 14/08 بعد مرور أربعة وأربعين سنة عن اصدار الأمر 70/20 كأول قانون للحالة المدنية عرفته الدولة الجزائرية المستقلة ، ثم تعديل آخر بقانون 17/03 مما أحدث نقلة نوعية في تنظيم الحالة المدنية بهدف مواكبة مختلف التطورات الاجتماعية والثقافية والتكنولوجية التي عرفتها الجزائر في ظل العولمة ، وتحسين أداء المرفق العام ، وذلك بتحرير وتصحيح وثائق الحالة المدنية إلكترونيا مع توسيع إختصاص الجهات القضائية للفصل في الإشكالات المتعلقة بها ,ولهذا حاولنا من خلال هذه الدراسة بيان التعديلات التي أدخلها قانون 17/03 وأثرها على النظام القانوني للحالة المدنية ، وما توصلنا إليه أن هذه التعديلات خطت بنظام الحالة المدنية خطوات كثيرة نحو العصرنة وقربت الإدارة من المواطن ، إلا أن ذلك مازال يحتاج الى إيجاد البيئة الالكترونية المناسبة لتفعيل هذه التعديلات . The civil status system in Algeria has known a great legislative development since the issuance of Law 14/08 after forty-four years after the issuance of Order 70/20 as the first civil status law known to the independent Algerian state, then another amendment to Law 17/03, which made a qualitative leap in the organization of civil status With the aim of keeping pace with the various social, cultural and technological developments that Algeria has known under globalization, and improving the performance of the public facility, by editing and correcting civil status documents electronically while expanding the jurisdiction of the judicial authorities to adjudicate related problems, and for this we tried through this study to clarify the amendments introduced by Law 17/ 03 and its impact on the legal system of the civil status, and what we have reached is that these amendments have taken the civil status system many steps towards modernization and brought the administration closer to the citizen, but this still needs to find the appropriate electronic environment to activate these amendments
