مشروعيّة الترخيص بالبناء و رقـــابة القـــــــاضي الإداري عليه The Legality Of Building Permits And The Administrative Judge’s Control Over It

الملخص
تُعتبر رُخصة البناء من أهم الرخص الإداريّة في مجال الأنشطة العمرانيّة و التي بواسطتها تبسط الجهات الإدارية المختصة رقابتها على أنشطة البناء و التأكد من مُطابقتها للمواصفات التقنيّة و القانونيّة المنصوص عليها في قوانين العمران، و ذلك بالمنح أو رفض المنح مع ضمان حقوق الأفراد و الغير المتضرر من هذه القرارات ، و بما أنهّا تأخذ حكم القرارات الإدارية فهي تخضع من جهة أخرى لرقابة القاضي الإداري الذي يختص بالنظر في مشروعيّة القرارات و التراخيص الممنوحة عن طريق دعويين:- دعوى الإلغاء و التي تتخذ أوجه فحص عدم المشروعيّة الداخليةّ و عدم المشروعيّة الخارجية ، - دعوى وقف تنفيذ تراخيص أعمال البناء و التعمير مع ضرورة توفر عنصري الاستعجال و شرط الشك الجدي. The building permit is considered one of the most important administrative licenses in the field of urban activities, through which the competent administrative authorities simplify their control over construction activities and ensure their compliance with the technical and legal specifications stipulated in the urban laws, by granting or refusing grants while ensuring the rights of individuals and third parties affected by These decisions, and since they take the rule of administrative decisions, are subject on the other hand to the supervision of the administrative judge who is competent to consider the legality of decisions and licenses granted through two lawsuits: - Annulment lawsuit, which takes aspects of examination of internal illegality and external illegality. A lawsuit to stop the implementation of building and reconstruction licenses, with the necessity of providing the elements of urgency and the condition of serious doubt.
