الملخص

الملخص اقتضت التحولات في طبيعة النظام السياسي والدستوري في الجزائر مواكبة ذلك بمنظومة قانونية تعكس تلك التحولات وفي هذا الإطار تم سن مجموعة من القوانين لاسيما تلك المتعلقة بالانتخابات وتم الأخذ بعدة نظم انتخابية فمن نظام الأغلبية البسيطة في دور واحد الى نظام التمثيل النسبي عن طريق القائمة المفتوحة مرورا بالنظام المختلط ونظام الأغلبية المطلقة ونظام التمثيل النسبي عن طريق القائمة المغلقة تكون التجربة الجزائرية قد عرفت ثراء في هذا المجال لكن هذا لايخفي الصعوبات أثناء الممارسة مما جعل من بعض تلك النظم الانتخابية مجرد نصوص قانونية لم تجد مجالا للتطبيق إما لأنها صادفت أزمات أو تسببت فيهاإلا أن السعي لتحقيق الاستقرارالمؤسساتي دفع المشرع الى إدخال التعديلات في القوانين بصفة مستمرة بما يضمن ذلك الإستقرار ويتماشى مع التحول الذي يعرفه المجتمع ويستجيب للمتطلبات. Abstract The nature of the political and constitutional transformation in Algeria required that it be accompanied by a legal system. These transformations reflect and in this context a set of laws were enacted, especially those related to elections, Several electoral systems have been adopted, from the simple majority system in one round to the proportional representation system through the open list, through the mixed system, the absolute majority system, and the proportional representation system through the closed list. The Algerian experience has known richness in this field, but this does not hide the difficulties during practice, which made some of these electoral systems mere legal texts that did not find any scope for application, either because they encountered crises or caused them. This ensures stability and is in line with the transformation that society knows and responds to requirements.
