الملخص
ملخص: تعتبر المراقبة بإستخدام تقنية السوار الالكتروني من أهم تطبيقات التطور العلمي التكنولوجي التي تدعم به مرفق العدالة الجزائية في مجال تطبيق العقوبات التي تبنتها السياسات العقابية المعاصرة، بإعتبارها تقنية تجنب الأشخاص مساوئ الوسط العقابي، فهي من جهة بديل عن إجراء الإيداع رهن الحبس المؤقت، إذ تساعد على مراقبة مدى إحترام المتهمين لإلتزامات الرقابة القضائية خلال سير الدعوى العمومية ، ومن جهة ثانية تعتبر بديل عن تطبيق العقوبات السالبة للحرية داخل المؤسسات العقابية خاصة قصيرة المدة منها،كآلية إجرائية تضمن إعادة تأهيل و إدماج المحكوم عليهم في المجتمع، و قد أقرت العديد من التشريعات هذه التقنية ومن بينها المشرع الجزائري. Monitoring using the electronic bracelet technology is one of the most important applications of technological scientific development in which the criminal justice facility supports the application of penalties adopted by contemporary punitive policies as a technique for avoiding the disadvantages of the penal environment, on the one hand it is an alternative to the procedure of placement in temporary detention as it helps to monitor the extent of respect Those accused of judicial oversight obligations during the course of the public lawsuit, and on the other hand, it is considered an alternative to applying negative penalties with in private penal institutions of short duration, as a procedural mechanism that guarantees the rehabilitation and integration of convicts into society, and many legislations have approved this technology, including the Algerian legislator.
