الملخص

إن الاعتراف للمواطنين بالحقوق السياسية المعلن عنها بالمادة 25 من العهد الدولي للحقوق المدنية والسياسية أساسا ، و ضمن أحكام الدستور والقانون العضوي المتعلق بنظام الانتخابات بصفة تبعية سيكون له أثرا محدودا ما لم يقترن بوجود إدارة انتخابية مستقلة وغير متحيزة ، هذا ما حاول المشرع الجزائري تجسيده من خلال استحداث السلطة الوطنية المستقلة للانتخابات كآلية جديدة تولت حصرا مهام التحضير والتنظيم والإدارة والإشراف على جميع العمليات الانتخابية بداية من استدعاء الهيئة الانتخابية إلى غاية إعلانها النتائج الأولية للانتخابات، وقد استمدت هذه السلطة المستقلة مرجعيتها من مبدأ سيادة الشعب ورغبته في إجراء انتخابات حرة تعددية شفافة ونزيهة ، وهو ما دعم مكانتها ضمن النظام المؤسساتي الدستوري والقانوني الجزائري، ومع حلولها محل الإدارة العمومية في المجال الانتخابي فقد أخضع المشرع قراراتها لرقابة القضاء كضمانة أكثر لحرية ونزاهة الانتخابات The recognition of the political rights of citizens stipulated mainly by the Article 25 of the International Covenant on Civil and Political Rights and subsequently within the Constitution’s Provisions and the Organic Law relating to the Electoral System, will have a limited impact unless combined by an impartial and independent electoral administration, this is what the Algerian Legislator has devoted by introducing a new mechanism which has been assumed exclusively the tasks of preparation, organization, management, supervision and monitoring all electoral processes, from the convocation of the electoral body until the announcement of the preliminary results of the elections. Therefore, this Independent Authority has derived its authority from the principle of the sovereignty of the people and its desire to hold free, multi-party, transparent and fair elections, this is what has strengthened its position within the Algerian constitutional institutional and legal system, and with its subrogation of public administration in the electoral matters, the legislator subjected its decisions to judicial control to guarantee more free and fair elections.
