إسهام الثورة الجزائرية في تطوير بعض مفاهيم مبادئ القانون الدولي

الملخص
بفضل الثورة الجزائرية 54- 1962 وصمودها وانتصاراتها الميدانية وتعاطف المجتمع الدولي معها أصبحت جبهة التحرير الوطني كحركة تحررية كيانا دوليا محاربا ومخاطبا بقواعد القانون الدولي ومعترفا بشرعية عملها المسلح الذي يخوضه جناحها العسكري جيش التحرير الوطني وهذا في حد ذاته يعتبر تحولا هاما لبعض المفاهيم والمبادئ الأساسية في نظام المجتمع الدولي المعاصر، حيث لم يكن ذلك التحول التزاما قانونيا وسياسيا وحتى أخلاقيا من دول الحلفاء المنتصرة في الحرب العالمية الثانية بقصد وضع حد لمآسي البشرية وتجنيبها ويلات الحروب كما ورد ذلك في ديباجة ميثاق الأمم المتحدة، إنما كان ذلك التغير نتيجة حتمية للمد التحرري الذي قادته الشعوب المستعمَرة والتي كان من أشهرها الثورة الجزائرية التي دفعت الأمم المتحدة إلى تبني مبدأ تقرير المصير وإرساء قاعدة تصفية الاستعمار وإعطاء العمل المسلح التحرري بعدا دوليا وإنسانيا مما استوجب معه تعديلاً لبعض مفاهيم ومبادئ القانون الدولي The contribution of the Algerian revolution in developing some of the principals of the international law conceptions and Abstract : Thanks to the Algerian revolution 54-1962 and its domain steadfastness and victories and The sympathy of the international community with it, the national liberation front becomes as a liberating movement international warrior entity addressing with the international law rules and recognizing the legitimacy of its armed action waged by its military wing the national liberation army , and this is considered as an important change of some principal conceptions in the system of the resent international community ,so that shift was not a legal and political binding and even not ethical by the victorious Allies in the second international war to put an end to the tragedies of mankind and the scourge of wars as stated in the preamble to the Charter of the United Nations, But that change was an inevitable result of the liberation tide led by the colonized peoples and the most famous of which was the Algerian revolution Which prompted the United Nations to adopt the principle of self-determination and to establish the basis of decolonization giving liberation armed action an international and humanitarian dimension, which necessitated an amendment to some concepts and principles of international law.
