ملخص : وقع نقاش مطول حول طبيعة النظام السياسي الإسلامي فيما يخص مدى ديمقراطية النظام ومدى دور المشاركة الشعبية العامة في تنظيم السلطة السياسية ، واختلفت الآراء في هذا الشأن من خلال تنوع المرجعيات الثقافية ،و كذا تعدد المناهج العلمية التي تم اعتمادها في تناول الدرس السياسي الإسلامي ، ولقد استقر الأمر في الفقه السياسي الإسلامي لدى النخبة الكاثرة من الفقهاء والباحثين في اعتماد الرضا والقبول الشعبي بالسلطة السياسة في إطار تعاقدي قائم على الاختيار والرضا محددا أساسيا للشرعية السياسية في النظام الإسلامي ، وقد استند هذا المذهب في اعتماد القواعد السياسية التي أرسيت في عهد النبوة ثم الممارسة العملية في فترة الخلافة الراشدة كإطار مرجعي في صياغة تلك المبادئ و الضوابط الناظمة لمسألة السلطة السياسية ، فلقد استقرت التجربة النبوية و تجربة الخلافة الراشدة على اعتماد الاختيار القائم على الرضا والقبول الشعبي بالسلطة من خلال عقد البيعة كركن ركين في اسناد السلطة وبناء الشرعية السياسية ،مما أضفى على السلطة السياسية الطابع المدني التمثيلي التعاقدي المنافي من جميع الأوجه لكل أنماط الأنظمة الاستبدادية والديكتاتورية التي كانت سائدة و راسخة الجذور في تلك الفترة، ما يجعل من النظام السياسي الإسلامي نظاما أصيلا في هذا الشأن. Abstract: There has been a long debate about the nature of the Islamic political system regarding the extent to which the system is democratic ,and The extent of public participation in the organization of political power, Opinions differed in this regard through the diversity of cultural references, as well as the multiplicity of scientific approaches that dealt with the Islamic political lesson,and The multiplicity of scientific curricula that dealt with the Islamic political lesson, and the matter has settled in Islamic political jurisprudence. The matter has settled in Islamic political jurisprudence among jurists and researchers in adopting popular consent and acceptance of political authority in a contractual framework based on choice and consent as a prerequisite for political legitimacy in the Islamic system, This doctrine was based on the adoption of the political rules established during the era of the Prophet and then the practical practice during the period of the Rightly-Guided Caliphate as a frame of reference in formulating the rules regulating the issue of political authority in the Islamic system, he prophetic and adult experience has settled on the adoption of popular contentment with authority through the pledge of allegiance as a cornerstone in assigning authority and building political legitimacy, He gave the political power a civil, representative, contractual character that is in contradiction in all respects to all types of authoritarian and dictatorial regimes, What makes the Islamic political system an authentic system in this regard.
