الملخص

عمدت التطورات الإقتصادية و التكنولوجية الكبرى التي شهدها العالم إلى فرض العديد من التغيرات على المجتمع و بالخصوص على الواقع القانوني ، و لعل أهم ما يترجم هذه التحولات تأثيرها على النظرية العامة للعقد بحيث مست مباشرة بالأسس التقليدية التي كانت تشيد على أساسها العقود منذ أمد بعيد مما خلق تحديثا جذريا أضفي على الأسس العتيقة في العقد و هجران المذهب الفردي ، مما يترجم مساهمة التحولات الإقتصادية و التكنولوجية في خلق إرهاصات طغت على النظرية العامة للعقد و كانت سببا في إزدهار العقد و انتعاش العديد من المبادئ العقدية التي بقيت رهينة الجمود و الكلاسيكية لحقبة من الزمن، بحيث أنّ هذه التفاعلات التكنولوجية و الاقتصادية عمدت إلى إزالة الغبار عن العديد من المبادئ فأحدث ذلك ثورة عقدية حفزت و أنعشت بعض المبادئ و أصابت بالتقهقر مبادئ أخرى. The major economic and technological developments that the world witnessed have imposed many changes on society, and in particular on the legal reality, and perhaps the most important translation of these transformations is the effect of these transformations on the general theory of the contract so that they directly touch the traditional foundations on which contracts were built long ago. Far from creating a serious modernization, it was added to the ancient foundations of the decade, which translates into the contribution of economic and technological changes in creating harbingers that overwhelmed the general theory of the decade and was the cause of the flourishing of the decade and the revival of many doctrinal principles that remained hostage to stagnation and classicism for a period of time, such that these interactions Technology and economics deliberately removed the dust from many principles, thus causing a decade-long revolution that stimulated and revived some principles and affected the retreat of other principles
