المؤسسات الناشئة في الجزائر -الإطار المفاهيمي والقانوني-

الملخص
على الرغم من كثرة الأبحاث والدراسات التي تناولت موضوع المؤسسات الناشئة -خاصة في الآونة الأخيرة- إلا أنه لم يتم الوقوف على إطار مفاهيمي دقيق وواضح لها، نظرا لتغلب الطابع الاقتصادي والابتكاري لمشاريع المؤسسات الناشئة، إذ من الصعب الوصول إلى مفهوم محدد، لا سيما وأن لهذا المصطلح مفهوم نسبي يرتكز على معايير تختلف من دولة لأخرى؛ ومن قطاع لآخر في الدولة الأخرى هذا من جهة. من جهة أخرى سعت الجزائر إلى وضع الأطر القانونية التنظيمية اللازمة للمؤسسات الناشئة؛ إذ تم إصدار نصوص تنظيمية تهتم بها؛ وتهتم بتلك حديثة النشأة وبتلك المشاريع الجديدة؛ بحيث تضمنت أحكامها تدابير متخصصة لصالح هذه المؤسسات؛ بهدف ترقيتها وتشجيعها على الابتكار. Despite the large number of research and studies that dealt with the issue of emerging enterprises - especially in recent times - an accurate and clear conceptual framework has not been identified, given the predominance of the economic and innovative nature of emerging enterprise projects, as it is difficult to reach a specific concept, especially since this The term is a relative concept based on criteria that differ from one country to another and from one sector to another in the other country, on the one hand. On the other hand, Algeria sought to develop the necessary regulatory legal frameworks for emerging institutions, as regulatory texts concerned with newly established institutions and new projects were issued. Their provisions included specialized measures for the benefit of emerging institutions and innovation to support and promote this type of institutions and encourage innovation.
